DUI and Blood Testing
When a driver is arrested by a law enforcement officer for suspected drunk driving, he or she must submit to a chemical test to determine BAC (blood alcohol concentration). One type of chemical test commonly used is a blood test, which is usually considered to be the most accurate type of chemical test that can be performed. During a blood alcohol test, blood is drawn from a person’s arm and is analyzed. If the blood test reveals the person’s blood alcohol concentration to be 0.08% or greater, that person is considered intoxicated. A blood test allows there to be evidence (a blood sample) which can be re-examined at a later date, as compared to a breath test which cannot be re-examined if there are any discrepancies.
It is important that all blood tests be performed by qualified individuals who have experience in drawing blood and evaluating test results. There are many cases in which blood tests are inaccurate, sometimes due to contaminated medical equipment, a poorly trained blood technician, or improper storage or transportation of the blood.
